Louisiana Expungement Law Nuts & Bolts

(2 credit hours) This class provides an overview of expungement law. It is intended for attorneys who have volunteered at a JAC expungement clinic in the past or seek to assist JAC with expungements in the future.  Sample forms and motions will be provided.  The updated "Nuts & Bolts & Beyond" manual WILL NOT BE PROVIDED. You may purchase a PDF or softcover version of the manual prior to class here.

AGENDA

I. Hour One – Process and Eligibility

• Establish a common understanding of how the criminal legal system works and illustrate that expungement law uses a combination of statutory law and procedural articles to determine eligibility. If-then statements
• Map the process from offense through expungement
• Classification of outcomes
• Offense specific limitations
• This year’s  changes to eligibility

II. Hour Two – Forms, Examples, and Legal Advice

• Apply legal eligibility screenings to practice and identify the necessary information to complete required forms
• Location, completion, bundling of forms
• Necessary exhibits and additions for specific jurisdictions
• Advising clients in the expungement contexts
• Hypotheticals to review eligibility
